Terms of Service

The agreement between you and i60 for the use of our website, products and services. Please read it carefully.

Effective date: 24 July 2026

These Terms of Service (“Terms”) govern your access to and use of the website, software products and services (together, the “Services”) provided by i60 Group (Pty) Ltd (“i60”, “we”, “us”, “our”). By accessing our website, creating an account or purchasing a subscription, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you confirm that you are authorised to bind that organisation.

01Definitions

  • “Services” — our website, software-as-a-service products, and any related services we provide.
  • “Subscription” — a recurring, paid plan giving you access to a Service for a billing period.
  • “Customer”, “you” — the person or organisation that uses the Services.
  • “Customer Data” — the data you and your users submit to or generate within the Services.

02Eligibility & accounts

You must be at least 18 years old and able to enter into a binding contract to use the Services. You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at support@i60.co if you suspect any unauthorised use. You must provide accurate, current and complete information and keep it up to date.

03The Services

We provide software products, primarily on a subscription (software-as-a-service) basis. The specific features, limits and plan applicable to you are those described at the point of sale or in an order form or agreement between us. We may improve, change or discontinue features from time to time; where a change materially reduces core functionality of a paid Service, we will give you reasonable notice.

04Subscriptions, fees & billing

  • Prices & currency. Unless stated otherwise, prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. The price and billing frequency for your plan are shown before you confirm your purchase.
  • Payment processor. Payments are processed securely by Paystack. By subscribing, you authorise us (through Paystack) to charge your chosen payment method for the fees due.
  • Recurring billing & renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually, as selected) at the then-current price, unless cancelled before the renewal date. We will treat your subscription as authorising these recurring charges until you cancel.
  • Price changes. We may change subscription prices. We will give you reasonable advance notice, and changes take effect from your next billing period. If you do not accept a price change, you may cancel before it takes effect.
  • Failed payments. If a payment fails, we may retry the charge and/or suspend or downgrade your access until the amount owing is settled.
  • Taxes. Fees are exclusive of any taxes not shown; you are responsible for any taxes that apply to you other than taxes on our income.

05Cancellation & refunds

You may cancel a subscription at any time; cancellation stops future renewals. Your statutory cooling-off rights and how refunds are handled are set out in full in our Refund Policy, which forms part of these Terms. Nothing in these Terms limits any right you have under the Consumer Protection Act, 68 of 2008 (“CPA”) or the Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”).

06Acceptable use

You agree not to, and not to permit anyone to:

  • use the Services unlawfully, or in breach of any applicable law or third-party rights;
  • upload malicious code, or attempt to gain unauthorised access to the Services or other accounts;
  • interfere with, disrupt, or place undue load on the Services or their infrastructure;
  • reverse-engineer, copy, resell or sublicense the Services except as expressly permitted; or
  • use the Services to store or transmit unlawful, infringing, harmful or abusive content.

07Intellectual property

The Services, and all software, content, branding and materials we provide, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription, subject to these Terms. You retain all rights in your Customer Data; you grant us the limited right to process it to provide and support the Services.

08Your data & privacy

Our handling of personal information is described in our Privacy Policy. You are responsible for ensuring you have the right to provide any personal information you submit to the Services, and for complying with applicable data-protection laws in your own use of them.

09Third-party services

The Services rely on third-party providers (for example, Paystack for payments and our hosting and e-mail providers). Your use of those services may also be governed by their own terms. We are not responsible for third-party services outside our control, though we choose our providers with care.

10Availability & support

We work hard to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, occasionally with little notice for urgent fixes. Where an order form or plan specifies a service level, that will apply. Support is available via support@i60.co.

11Warranties & disclaimers

Except as expressly stated in these Terms and to the fullest extent permitted by law, the Services are provided “as is” and “as available”, and we disclaim all other warranties, whether express or implied. This clause does not exclude or limit any warranty, right or remedy that applies to you and cannot lawfully be excluded under the CPA or other applicable law.

12Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill. Our total liability arising out of or relating to the Services in any 12-month period will not exceed the amount you paid us for the Services during that period. Nothing in these Terms limits liability that cannot be limited by law — including liability under the CPA, or for fraud, or for death or personal injury caused by our negligence.

13Your consumer rights

If you are a “consumer” under the CPA, you enjoy statutory protections that apply regardless of these Terms. Nothing in these Terms is intended to, or does, waive, exclude or limit any right you have under the CPA or ECTA. Where any provision conflicts with those rights, your statutory rights prevail.

14Suspension & termination

You may stop using the Services and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms (including non-payment), or where required by law, giving you notice and an opportunity to remedy the breach where reasonable and lawful to do so. On termination, your right to use the Services ends; provisions that by their nature should survive (such as fees owed, intellectual property, and liability) will survive.

15Governing law & disputes

These Terms are governed by the laws of the Republic of South Africa. If a dispute arises, please first contact us at legal@i60.co so we can try to resolve it. You may also refer certain disputes to the National Consumer Commission or an accredited consumer body. Subject to your statutory rights, the courts of South Africa have jurisdiction over any dispute relating to these Terms.

16Changes to these Terms

We may update these Terms from time to time. We will revise the “effective date” above and, for material changes, take reasonable steps to notify you. Continued use of the Services after an update means you accept the revised Terms.

17General

  • Entire agreement. These Terms, our Privacy Policy and Refund Policy, and any order form, are the entire agreement between us regarding the Services.
  • Severability. If any provision is found unenforceable, the rest remain in effect.
  • Assignment. You may not assign these Terms without our consent; we may assign them to a successor of our business.
  • No waiver. Our failure to enforce a right is not a waiver of it.
